Our Commitment to Your Privacy: Monarch Capital Group, LLC (“Monarch Capital”) has a policy of protecting the confidentiality and security of information we collect about our clients. We do not share non-public information about you outside of Monarch Capital or Pershing, LLC, our clearing firm, without your consent, except for the specific purposes described below, in accordance with all applicable laws. This Notice describes the information we may gather and the circumstances under which we may share it.
Why We Collect and How We Use Information: We limit the collection and use of information to the minimum that we require to deliver exceptional service to you. This includes advising you of relevant products, services and other opportunities, maintaining your Monarch Capital accounts, processing transactions requested by you or other persons authorized by you, and all other activities related to us conducting business and providing service.
How We Gather Information: Most of the personal information we have on record is supplied by you, when you apply for, access and/or use Monarch Capital’s financial products and services---whether in person, by telephone or electronically. In some cases, we verify this information or obtain additional personal information from third-party sources. We may, for instance, seek more information on your personal finances, employment, and personal interests, as well as transactions and financial interactions with or through our firm and/or other institutions.
How We Protect Information: Our employees and registered representatives, acting on our behalf, are required to protect the confidentiality of information and to comply with our established policies. They may access information only if and when there is a valid and justifiable reason to do so – for instance, in order to offer or provide relevant and appropriate products and services to our clients. We also maintain physical, electronic and procedural safeguards to protect information, which comply with all applicable laws. Employees who violate our Privacy Policy will be subject to a disciplinary process.
Disclosure of Information: We will disclose information that we deem necessary to conduct our business, or when disclosure is required by law. For example, we may disclose information to attorneys or other professionals for audit or research purposes or to law enforcement and regulatory agencies to help prevent – among other things – fraud and money laundering. In addition, we may disclose information to our clearing firm or to third-party service
providers, (i) to enable them to provide us with general computer, data-maintenance or processing services, (ii) to process client-requested transactions, or (iii) for credit review or reporting purposes. We may also provide information to Pershing or other non-affiliated companies – including third-party financial institutions, trust companies, and other firms – that enable us to offer our clients specialized products or services. We will not make any disclosures of information to other companies who may want to sell their products or services to you directly. For example, we do not sell customer lists, nor do we sell client names to catalog companies or telemarketers.
Our Former Clients: Our Privacy Policy actively covers and protects former clients as well as current clients of Monarch Capital.
To Whom This Policy Applies: This Privacy Policy applies to Monarch Capital Group LLC, Monarch Holdings LLC, and the other members of the Monarch corporate family.
Access to and Correction of Information: Upon your written request, we will make available for your review any file that we maintain of your personal information; provided, however, that any information collected in connection with or in anticipation of any claim or legal proceeding will not be made available. If you notify us that information is incorrect, we will review it. If we agree, we will correct our records. If we do not agree, you may submit a short statement of dispute, which we will include with any future disclosure of the disputed information.
